On the termination of Article 19 of the Law of the Republic of Azerbaijan “On Labor Pensions” included in the Envelope Budgeting and, therefore, on the normative legal acts to be amended and re-drafted

1. Termination of Article 19 of the Law of AR on “Labor Pensions”

- Supplements to the insurance part of the labor pension diminish the social insurance principles in the pension system and the process for financing of those supplements is too complicated.

- For this purpose, it is proposed to terminate the pension supplements provided by this article and merge them with the benefits of the current President of the Republic of Azerbaijan; to establish benefits for the new President of the Republic of Azerbaijan instead of both.

- Increasing of presidential benefits by terminating the pension supplements will affect to improve the social welfare of those receiving these pensions and Presidential benefits, as well as accelerate the electronic implementation of such social appointments.

2. NLAs to be amended with the termination of Article 19 of the Law

· Amendments to the Law of the Republic of Azerbaijan “On social benefits”

- As a continuation of the optimization of the amount and unification of the types of social benefits, which began last year as part of legislative reforms, it is proposed to increase the amounts of benefits of the President of the Republic of Azerbaijan for the relevant category by terminating social benefits paid to martyrs' family members, children of martyrs, children of war, January 20, 1990 and Chernobyl disabled persons.

· Increasing the amount of the benefit of the President of the Republic of Azerbaijan to the persons named to the National Hero of the Republic of Azerbaijan - Amendment to the Decree of the President of AR

- It is proposed to increase the amount of the Presidential benefit from 1,500 to 1,800 manat.

· Increasing the amount of Presidential benefit to the martyr’s family - Amendment to the Decree of the President of AR

- It is proposed to increase the amount of the Presidential benefit to the martyr's family (including persons killed in Afghanistan and the martyrs

of January 20) from 300 to 500 manat (In addition to pensions, these individuals also receive benefits or pensions monthly).

· Increasing the amount of Presidential grant to persons with disabilities connected with the war or the events of January 20, 1990 - Amendment to the Decree of the President of AR

- It is proposed to increase the amount of AR Presidential benefit from 250 to 400 manat for people with I group of disability, from 230 to 350 manat with II group of disability, from 210 to 300 manat with III group of disability due to the war (In addition to pensions, these individuals also receive benefits or pensions monthly).

· Increasing the amount of benefit of the President of the Republic of Azerbaijan to persons with disabilities of 1st group due to general reasons - Amendment to the Decree of the President of AR

- It is proposed to increase the amount of AR Presidential benefit to persons with disabilities of 1st group due to general reasons from 100 to 130 manat (In addition to pensions, these individuals also receive benefits or pensions monthly).

· Increasing the amount of Presidential benefit of the President of the Republic of Azerbaijan for participants of the Great Patriotic War - Amendment to the Decree of the President of AR

- It is proposed to increase the amount of AR Presidential benefit for participants of the Great Patriotic War from 150 to 300 manat (In addition to pensions, these individuals also receive benefits or pensions monthly).

3. Normative legal acts to be adopted with adoption of the Law of the Republic of Azerbaijan “On Amendments to the Law of the Republic of Azerbaijan on “Labor pensions” (termination of Article 19)

· Establishment of a new type of Presidential benefits for persons with 1st group visual impairment

- It is proposed to establish a new type of Presidential benefit to persons with 1st group visual impairment due to general reasons in the amount of 210 manat by terminating pension supplement in the amount of 110 manat and the Presidential benefit in the amount of 100 manat.

· Establishment of the “Presidential Grant of the Republic of Azerbaijan for persons with the right to a non-working pension with a scientific degree of at least 25 years of experience in scientific institutions and organizations or educational institutions at the main place of work

- It is proposed to establish a new type of presidential grant in the same amounts by abolishing the pension supplement in the amount of 120 (doctors of philosophy) and 200 (doctors of sciences) manats for these persons (excluding labor pensioners who were assigned supplements to the labor pension for length of service in accordance with Article 20 of the Law).

4. Final information

· Continuation of payment of pension supplement in current appointments under Articles 19.1.1, 19.1.3, 19.1.5 and 19.1.8 of the Law

- It is proposed to continue the payment of 110 manat to the families of the National Heroes of Azerbaijan, 93.5 manat to the families of the martyrs, to unemployed I and II groups of disabled people or persons with disabilities up to 18 years of age who have incapacitated family members, as well as disabled family members of non-working servicemen who are disabled family members belonging to the persons to be provided with a pension for the loss of the head of the family, to each incapable family member, persons who were later acquitted of political repression, participants of the Great Patriotic War and persons with disabilities in this regard.
